چکیده پایان نامه:

God has guided human towards their perfection while people are divided to three types in reaction to accepting this blessing. One accepts, another rejects, one another will return from the right way after accepting. The last group is entitled apostate. There are specific rules in Islam about them. Therefore, it seems to be necessary to be familiar who apostate is and what the conditions of its realization are. This article is dedicated to discuss about the jurisprudential aspect of apostasy. This research has been written in a library and descriptive manner

A Muslim who has exited the religion of Islam is called an apostate. Apostasy has the legal essence based on the evidence of consensus and tradition. Denials of Allah Almighty, the belief in unity of Allah, the mission of the Prophet (PBUH), as well as some essential issues of religion are the causes of apostasy. Each denial of Allah Almighty, the mission of the prophets, and the denial of the Prophet of Islam (PBUH) are an independent cause for apostasy. While there is a controversy on whether denying the necessities of sect is an independent cause for apostasy or if it leads to the denial of the above, leads to apostasy. The conditions for the realization of apostasy are puberty, sanity, freewill, intending the implication of the word and the apostate's knowledge regarding the implication of his words.
